Using this website

This site is published by ThoughtfulEyes, Melbourne, Victoria. The content is general information about what we do. It isn't advice for your particular situation, and nothing on the site creates an agreement between us — that happens when we've talked, agreed the job in writing, and you've said yes.

Prices shown are in Australian dollars and are indicative. The price for your engagement is the one we quote you in writing.

Engaging us

When you engage us to build and run an agent, the specifics — what it does, what it costs, what "working" means, and what we each need to provide — are set out in a written scope for your business. That scope, plus these terms, is the agreement. Where the two conflict, the scope wins.

Term and notice

Engagements run month to month. Either side can end it with thirty days' written notice. There is no minimum term, no exit fee and no lock-in. Fees are payable monthly in advance; any one-off build fee is payable as set out in your scope. All fees quoted on this site and in your scope are in Australian dollars and exclusive of GST, which is added at the prevailing rate.

What the monthly fee includes

The monthly fee covers running your agent: the third-party services it depends on — AI model usage, telephony and phone numbers, hosting and storage — together with monitoring, escalation and ongoing tuning. Those accounts are held and paid by us. You do not need your own AI subscription or licence.

Each agent is scoped to an expected monthly volume, recorded in your scope. Fees assume usage broadly in line with it. If your volume rises materially and consistently above that level, we will raise it with you and agree a revised fee or scope in writing before any change takes effect. We will not issue usage charges you have not agreed to in advance. Where your job depends on a paid third-party service contracted in your own name, that remains your cost and we will identify it before you commit.

What we do

We build the agent, connect it to the systems you nominate, monitor it, and keep it tuned. We escalate anything urgent, unusual, expensive or sensitive to you rather than letting the agent decide. We document what we've built and give that documentation to you.

What you do

You give us accurate information about how the job works today, timely access to the systems the agent needs, and a nominated person who can answer questions and approve things. You remain responsible for the commercial decisions your business makes, and for the accuracy of the prices, policies and commitments you ask the agent to communicate.

Your data and your customers

Information about your business and your customers stays yours. We hold and process it only to provide the service, in line with our privacy policy. On request at any time, and automatically at the end of an engagement, we return or delete it, subject to any records we're legally required to keep.

You're responsible for having a lawful basis to hand us the customer information you give us access to, and for telling your customers what they need to be told.

What we build

You own the configuration, prompts, workflows and documentation we produce specifically for your business, and you may take them in-house. We keep ownership of our general methods, templates and tooling — the things we bring to every engagement — and nothing here stops us building similar agents for other businesses.

Limits

AI systems make mistakes. We design for that — the agent escalates rather than guesses, and you see everything it does — but we can't promise it will never get something wrong, and you shouldn't rely on it as the sole check on anything critical, regulated or safety-related.

We can't control the availability of the third-party systems an agent depends on, and we're not liable for their outages.

Nothing in these terms excludes any right or guarantee under the Australian Consumer Law that can't lawfully be excluded. Subject to that, our total liability in connection with an engagement is limited to the fees you paid us in the three months before the claim arose, and neither of us is liable for indirect or consequential loss.

Insurance

We hold professional indemnity, public liability and cyber insurance. Certificates of currency are available on request.

Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
